Evian Haute Courture by Jean Paul Gaultier

This month, during FW ‘09 New York Fashion Week, Bergdorf Goodman will host a public unveiling of the Evian® Haute Couture “Bubble” Bottle by Jean Paul Gaultier. Five bottles, fabricated by the House of Baccarat, will tour different parts of the world, for display during February, then return to Paris for auction in March. Proceeds benefit the RAMSAR Convention.

The second annual offering of this Haute edition, again has an affordable cousin, the Pret-A-Porte bottle, available in cases of 12 for only $118. And the Evian Store is stocked with both Christian Lacroix’s bottle for 2008 and Gaultier’s 2009 design. CK “Face” makeup – Tip of the day!

We recently saw a CK ad and, literally, said aloud, “Holy crap is that makeup marvelous!” So obviously, we investigated. The CK “Face” collection is brand new and goes hand in hand with the CK girl’s wardrobe – minimal yet modern. Even cooler is the fact that they pull many of the makeup shades right off of the runway, converting trendy fabrics and hues into colors for the “Face.”

If you log onto Sephora you can browse the collection, get some cool tips and tricks, and even see precisely how the artist did the model’s makeup to really wrap you head around that CK look. Balenciaga Sues Steve Madden Over 'LEGO' Heels

Steve Madden may have to reconsider its designer-inspired shoes.

After being sued by Alexander McQueen earlier this year, the trendy mass shoemaker is now facing a copyright infringement suit over Balenciaga's "LEGO" heels, reports Cityfile.

The French luxury house slapped Madden with the lawsuit in the U.S. District Court of Eastern New York.

According to the court documents, soon after Balenciaga's multicolored peep-toe heels from the Fall 2007 collection were released, Steve Madden issued its own (more affordable) look-alike version, says the source.

As part of its courtroom argument, Balenciaga points to Madden's alleged shady past: "Defendant Steve Madden's reputation for producing knock-offs of full price luxury designs further corroborates Defendant's deliberate pattern of willful infringement and unfair competition."

While, we're all for wallet-friendly fashion, has Madden gone too far with this runway replica?

THE SCOOP: At Lela Rose Spring 2010, it was all about the beach. Fluttery fabrics in vibrant brights abounded; for beauty that meant ultra textured hair and watercolor-inspired eye shadows that conjured up a sunset in San Tropez. "The eye makeup is a muted version of the colors in the clothing," said Lucero. "And we're using lots of matte bronzer, so it looks like the girls fell asleep in the sun."

For hair, Gibson was inspired by the wave patterns in the collection. "It's a girl in St. Barth's who's doesn't have time to wash her hair after she' been in the water all morning," said Gibson. When you're at the beach the sun, water and wind all mix together for incredible texture. Gibson recreated that look by putting waves in the hair, then backcombing at the roots and pulling tresses into a low, bushy ponytail.

The manicures were a polished, pretty tone of pinky nude. "We're doing an old fashioned thing by matching the manicure color and pedicure color to the lips," said Lippmann. "Women used to do that with red, but we're modernizing the idea by using a pinky beige shade."

W?hrend sich der Bundesverband deutscher Wohnungs- und Immobilienunternehmen (GdW) erfreut über das Urteil zeigte, hagelte es Kritik vonseiten des Deutschen Mieterbundes (DMB): ?Das Recht zur Mietminderung und die Berechnung der Wohnfl?che müssen anhand gesetzlicher Regelungen bestimmt werden und dürfen nicht vom Einschreiten der Beh?rden abh?ngig sein“, so der Direktor des DMB, Lukas Siebenkotten.

22,6 Quadratmeter gro? ist das Dachgeschoss des Einfamilienhauses in München, das die Kl?ger 1989 angemietet hatten. Die Dachgeschossr?ume wurden als Wohnraum vermietet und jahrelang auch als solcher genutzt. Als die Mieter erfuhren, dass sie laut Bauordnung nicht zum Wohnen geeignet sind, forderten sie eine Mietrückzahlung für die betreffende Fl?che. Das Landgericht München wies die Klage zurück, am Mittwoch scheiterten die Kl?ger auch vor dem Bundesgerichtshof.

BGH: Keine Mietrückzahlung trotz Versto? gegen die Bauvorschriften

R?ume, die nicht den Bauvorschriften entsprechen und somit nicht zum Wohnen geeignet sind, k?nnen unter Umst?nden trotzdem zur Gesamtwohnfl?che gerechnet werden, wie der Bundesgerichtshof in Karlsruhe gestern entschied. Denn auch ungeeignete R?ume kann man zum Wohnen nutzen – zumindest, solang die Beh?rden nicht eingreifen.




Dass alle Wohnr?ume einer Mietsache zur Wohnfl?che z?hlen, für die jeden Monat Miete f?llig wird, ist hinreichend bekannt. Wenn aber einzelne R?ume die Vorschriften des Bauordnungsrechts nicht erfüllen und somit für Wohnzwecke ungeeignet sind, werden sie auch nicht zur Wohnfl?che gerechnet – so steht es zumindest in der Wohnfl?chenverordnung. In einem aktuellen Fall sah der BGH das allerdings anders: Obwohl das Dachgeschoss eines Einfamilienhauses gegen die ?ffentlich-rechtlichen Bauvorschriften verst??t, müssen die Mieter weiterhin auch für diese Fl?che Miete zahlen.

Wenn die berechnete Fl?che über 10 Prozent gr??er ist als die tats?chliche, besteht ein Anspruch auf die Rückerstattung der zu viel gezahlten Miete. Der BGH wies die Klage am Mittwoch dennoch ab. Die Begründung des Urteils: Das Dachgeschoss sei zwar offiziell für Wohnzwecke ungeeignet, es war aber zum Wohnen vermietet und wurde auch dementsprechend genutzt, deshalb muss die Miete gezahlt werden. W?ren die Beh?rden aktiv geworden und h?tten die Nutzung des Dachgeschosses als Wohnr?ume untersagt, h?tten die Mieter wohl recht bekommen. So best?tigten die Karlsruher Richter das Urteil des Landgerichts München.

Sch?nheitsreparaturen und Renovierung von Mietwohnungen sind seit Langem ein leidiges Thema mit vielen Missverst?ndnissen und Unklarheiten. Der Bundesgerichtshof hat nun erneut die Rechte der Mieter bei Gestaltung ihrer Wohnung gest?rkt und für Licht im Dunkel gesorgt. In einem Urteil stellte der BGH klar, dass Klauseln, die dem Mieter vorschreiben, Türen und Fenster in einer bestimmten Farbe zu streichen, ungültig sind und dazu führen, dass der Mieter gar keine Sch?nheitsreparaturen durchführen muss.

Der Vermieterin stehe kein Schadensersatz zu, da Klauseln, die den Mieter w?hrend der Mietvertragslaufzeit zur Renovierung in einer bestimmten Farbe verpflichten, unwirksam sind. Der Vermieter dürfe die Gestaltung des pers?nlichen Lebensraumes nicht vorgeben. Allenfalls seien solche Farbvorgaben bei der Rückgabe der Wohnung m?glich. Die Richtiger gingen sogar noch einen Schritt weiter: ?Die unzul?ssige Farbvorgabe führt zur Unwirksamkeit der Sch?nheitsreparaturen schlechthin“, so das BGH.

Der BGH best?tigte mit diesem Urteil seine bisherige Rechtssprechung. So urteilte er bereits in der Vergangenheit, dass die Vorgabe, W?nde zu wei?en ungültig sei, oder das Mieter die Kosten für unn?tige Reparaturen zurückfordern k?nnen.

BGH: Farbvorgabe für Fenster und Türen ist unwirksam

Vermieter dürfen ihren Mietern keine Farbvorgaben für die Gestaltung der Wohnung machen. Das gilt auch für den Anstrich von Türen und Fensternrahmen, wie der Bundesgerichtshof (BGH) in Karlsruhe entschieden hat. Entsprechende Mietvertragsklauseln gelten maximal für die Wohnungsrückgabe.

Die Farben sind frei – wer kann sie verbieten? Der Vermieter jedenfalls nicht.

Im verhandelten Fall gab eine Klausel vor, dass ?bei der Ausführung von Sch?nheitsreparaturen die Türbl?tter, Türrahmen, Fensterflügel und Fensterrahmen … nur wei? zu lackieren … sind.“ Nachdem die Mieterin nach dem Ende des Mietverh?ltnisses ohne entsprechende Renovierung auszog, klagte die Vermieterin auf Schadensersatz wegen unterlassener Sch?nheitsrenovierung. Der Bundesgerichtshof wies die Klage wie die Vorinstanzen Amtsgericht Sch?neberg und Landgericht Berlin zurück.


AZ: BGH VIII ZR 50/09

Der Direktor des Deutschen Mieterbundes, Lukas Siebenkotten, nannte die Entscheidung ?richtig, konsequent und so auch zu erwarten“. ?Entscheidend ist, dass niemand dem Mieter w?hrend der Mietzeit vorschreiben darf, ob er die W?nde oder Türen in seiner Wohnung wei?, gelb, grün oder rot streicht. Der Vermieter darf auch nicht vorgeben, ob der Mieter w?hrend der Mietzeit Raufasertapete oder Blümchentapete klebt. Das ist und bleibt allein Sache des Mieters“, so Siebenkotten weiter.

But there was an emerging consensus that Sweeney’s defensive profile wouldn’t allow him to stick at third base, where we already have options in Figgins, Wood, and perhaps even Rodriguez for several years to come. So that leaves first base, where we’ve seen our Cuban Commando decisively raise a flag this season.

On the same night that Kendry Morales went 5-for-5 in a resounding win in Angels Stadium, first baseman Baird was also on five times in five chances, with three hits, two walks, two runs and two RBIs. Over 178 ABs in the Pioneer League, he’s put up the following line:

This is a player who is roughly the same age as Sweeney, and since he is a college prepster, could’ve likely been playing effectively at Rancho right now alongside Sweeney and his fellow draftee Jake Rife, save for Tom Kotchman’s appetite for team victories and an organizational desire to slow walk him in absence of any need to accelerate his progress.

But if anyone was wondering who is next in line after Kendry (long, long may he live!), this is the name to watch, not Trumbo, or Jacobo or any other bobo.
